Terms of Service
These terms are an agreement between you and My Company for using nextup.theaifoundry.net and buying NEXTUP products. By placing an order you accept them and our Privacy Policy.
1. Who can order
You must be 18 or older. If the card shows someone else, you confirm you are that person's parent or legal guardian, or have their permission (or their guardian's).
2. Your photos and content
You keep ownership of your photos and details. You give us a limited licence to use them only to make, show you, review, print and deliver your order, ending when we delete them under the Privacy Policy. You confirm that your photo and text:
- are yours to use, or you have permission;
- don't include other people's logos, team or league marks, or copyrighted images you don't have rights to;
- aren't offensive, sexual, violent, hateful, or meant to harass or impersonate anyone.
We may refuse or cancel an order that breaks these rules, with a full refund if it hasn't been printed.
3. AI artwork
If you choose AI artwork, we use OpenAI's image service to create versions based on your photo. AI results can vary. Before paying you see the artwork and check a preview of the card front and back; please check names, numbers and spelling carefully. Our team also reviews every card before printing and may contact you if the artwork doesn't look like the athlete. You can always choose the Classic card, which uses your photo with no AI artwork.
4. Products, prices and payment
Products, add-ons and prices are shown on the site at the time of your order and include or add tax and shipping as shown at checkout. Payment is taken by Stripe when you place the order. Digital cards are delivered by a private link after payment and review.
5. Printing and colour
Printed colours, chrome and foil effects can look different from your screen. Premium finishes appear only where we can produce them; the preview shows where they will be.
6. Changes, cancellations and refunds
Because every card is made to order:

Digital cards can't be refunded once downloaded, unless they are faulty.
7. Shipping
We ship to United States addresses. Delivery estimates are not guaranteed. Risk of loss passes to you on delivery.
8. Our content
The NEXTUP name, logo, card designs, templates and site are ours. You may share your own card and digital card for personal use. You may not resell NEXTUP products or reuse our designs commercially.
9. Limits on liability
The site and products are provided as described, and to the extent the law allows, our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits rights you have under consumer protection law that can't be waived.
10. Governing law and disputes
These terms are governed by the laws of [state]. Before filing any claim, contact us at support@theaifoundry.net so we can try to fix it.
11. Changes to these terms
We may update these terms; the version you accepted applies to your order.
